This law establishes a "Community Garden Commission" and sets forth various organizational details for the same including membership, jurisdiction, structure and reporting. The law also directs the commission to organize, coordinate, set policies and provide oversight for the various "community gardens" on city-owned or controlled property (with exceptions). It directs the Commission to issue regulations (it is unclear if it has done so), and allows it to set annual fees for allocated garden plots to cover necessary garden expenses, and directs that participants should be treated fairly and equitably with respect to fees.
"There is hereby established in the City of Medford a 'Community Garden Commission.'" § 2-549. The law also describes the purpose of the Commission: "The function and purpose of the commission is to organize, coordinate, set policies and provide oversight for the various 'community gardens' as now established and to be established prospectively on property owned, controlled or managed by the City of Medford, with the specific exception of the community gardens that presently exist at Riverbend Park in Medford." §2-550.
The law sets forth a procedures for application review, and charges the Zoning Administrator and Director of Buildings and Inspections with specific administrative responsibilities and authority. Chapter 1441.
"Whoever violates any provision of the Cincinnati Zoning Code or fails to conform to any provision thereof or fails to obey any lawful order of the Director of Buildings and Inspections issued in pursuance thereof, is guilty of a misdemeanor of the third degree on the first offense and guilty of a misdemeanor of the first degree on the second and subsequent offense. Each day's continuation of a violation or failure to comply is a separate offense." § 1451-09.
