Long Beach, Cal., Municipal Code ch. 5.95 (current through Nov. 3, 2021)

This law, enacted via emergency ordinance in 2021, limits third-party food delivery service fees and requires every third-party food delivery service provider to disclose to the customer, "in plain language and in a conspicuous manner, any commission, fee, or any other monetary payment" it charges to the customer. It creates a private right of action, with the possibility for prevailing plaintiffs to recover reasonable attorneys' fees and costs, and allows for criminal penalties. The law also requires the City Manager, or designee, to report back to the City Council and Mayor every 90 days on whether the provisions of this Chapter are still necessary based on the City's recovery from the health and economic impacts of the COVID-19 pandemic.
